Proposed Session Description:

Determination of the causation of a conventional podium slab deflection during the work that resulted in the need to correct and modify the superstructure above the slab. The claim was made to the all-risk insurance provider regarding an unexpected condition of slab deformation and the resulting peril. The peril(s) were analyzed in light of the potential causes in relation to the builder's risk policies and potential coverage. Trial was conducted in U.S. District Court and the jury verdict was reached on the matter. This topic will cover the history of the claim, the claim(s) that were made, the forensic evaluation and the policy application.
